1. Acceptance of Terms
By accessing or using ListingKit ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including real estate agents and brokers who subscribe to the Service.
2. Service Description
ListingKit is a SaaS platform for real estate agents that provides AI-generated listing content, photo and video management, public listing pages, lead capture, and social media publishing tools. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. Payment Terms
ListingKit is offered as a monthly subscription at $49 per month. Billing occurs on the same calendar day each month starting from your signup date. All fees are charged in US dollars and are non-refundable except as described in our Refund Policy. We use industry-standard payment processors and do not store your payment card details on our servers.
4. Cancellation Policy
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain full access until then. We do not charge cancellation fees. See our Refund Policy for information about refunds within the first 7 days.
5. User Responsibilities
You are responsible for all content you upload or publish through the Service, including listing photos, videos, and descriptions. You agree not to use the Service for any unlawful purpose, to upload content you do not have the right to share, or to misrepresent property information to buyers or leads.
6. Intellectual Property
You retain ownership of all content you upload. By using the Service, you grant ListingKit a limited, non-exclusive license to store and display your content solely for the purpose of providing the Service. AI-generated content produced by the Service is provided to you for your unrestricted commercial use.
7. Limitation of Liability
To the fullest extent permitted by law, ListingKit and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or suitable for any particular purpose. You are responsible for reviewing all generated content before publishing.
9. Changes to Terms
We may update these Terms at any time. We will notify you of material changes by email or by displaying a notice in the Service. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
